IV. Where do we store your data?

The personal data that we collected from you is generally stored within a country of the European Union or the European Economic Area (“EU/EEA”) but may also, whenever necessary, be transferred to and processed in a country outside of the EU/EEA. Any such transfer of your personal data will be carried out in compliance with applicable laws and without undermining your statutory rights.

V. Who has access to your data?

Your personal data is available and accessible only by those who need the data to accomplish the intended processing purpose. To the extent necessary, your personal data may be shared between the companies and brands within THEANA, with suppliers and sub-contractors (processors and sub-processors) carrying out certain tasks on THEANA’s behalf and with independent third-parties.

THEANA is not allowed to collect, process, use, store etc. personal data without a valid legal ground. I. Right of access:

You have the right to request information about the personal data that we hold about you. You can contact Customer Service who sends your personal information by email.

II. Right of portability:

When THEANA processes your personal data by automated means based on your consent or agreement, you have the right to obtain a copy of your data transferred to you or to another party in a structured and current format. This only concerns the personal data that you have transmitted to us.

III. Right of rectification:

You have the right to request the rectification of your personal data if it is inaccurate, including to supplement your incomplete personal data.

If you have a THEANA account or are a Club member, you can edit your personal details in your account or member pages.

IV. Right of deletion:

You have the right to delete any personal data processed by THEANA at any time, except in the following situations:

  • You have an ongoing matter with Customer Service.
  • You have an order in progress which has not yet been delivered or which has been partially delivered.
  • You have debts with THEANA, regardless of the method of payment.
  • You are suspected of having or have used our services fraudulently in the past four years.

V. Legitimate right of opposition:

You have the right to object to the processing of your personal data on the basis of THEANA’s legitimate interest. THEANA will cease to use your personal data unless we prove the merits of the use of your data which overrides your interests and your rights or for legal reasons.

VI. Right of restriction:

You have the right to request that THEANA limit the use of your personal data in the following circumstances:

  • If you object to the processing of your data on the basis of a legitimate interest of THEANA. THEANA will restrict the processing of this data while the legitimate interest is verified.
  • If you declare that your personal data is inaccurate, THEANA must limit the processing of this data pending verification of the accuracy of the personal data.
  • If the processing is illegal, you can object to the deletion of personal data and request the limitation of the use of your personal data.
  • If THEANA no longer needs the personal data but is necessary for the defence of legal claims.
